Please read these Terms of Service ("Terms") carefully before using the Hoka Lash Studio platform (the "Service") operated by Hoka Lash Studio ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Hoka Lash Studio provides lash artists with a suite of tools to manage their business, including booking calendars, website hosting, social media planners, SMS/email automation, payment processing, client management (CRM), an affiliate program, and educational content (the "Lash Business Course Library" and live Q&A sessions).

3. Subscriptions and Payment

A. Free Trial & Monthly Subscription

We offer a 14-day free trial, which requires a valid payment method. Your card will be automatically charged the monthly subscription fee of $27 at the end of the trial unless you cancel. Subscriptions auto-renew monthly. Payments are non-refundable.

B. Payment Information

You agree to keep your payment information accurate and up-to-date. Failure to do so may result in the suspension or termination of your account.

4. Third-Party Services and Integrations

The Service allows you to connect third-party accounts, such as social media platforms. By using these integrations, you grant us permission to access your third-party account and perform actions on your behalf (e.g., posting content). Your use of third-party services is subject to their respective terms and privacy policies. We are not liable for the actions or availability of any third-party service.

5. Affiliate Program

We offer an affiliate program. By participating, you agree to our Affiliate Program rules, which will be provided to you upon registration. You agree to promote the Service ethically and not to engage in spam or deceptive marketing. We reserve the right to terminate your participation in the affiliate program at our discretion for any violation of these terms.

6. Educational Content

The content provided in the Lash Business Course Library and during live Q&A sessions is for informational and educational purposes only. It does not constitute professional, legal, or financial advice. This content is the intellectual property of Hoka Lash Studio and may not be copied, shared, or redistributed without our express written permission. Access to this content is contingent upon an active subscription.

7. User Content and Responsibilities

You are solely responsible for all data, client information, and other content ("User Content") you upload. You warrant that you have all necessary rights and consents (especially from your clients) to use this content in connection with the Service and that it does not violate any laws.

8. Intellectual Property Rights

Excluding your User Content, the Service and its original content, features, and functionality are the exclusive property of Hoka Lash Studio.

9. Prohibited Conduct

You agree not to use the Service for any unlawful purpose or to violate these Terms. This includes infringing on intellectual property rights, disrupting the Service, or uploading malicious content.

10. Termination

You may terminate your account by canceling your subscription. We reserve the right to suspend or terminate your account if you breach these Terms.

11. Disclaimer of Warranties & Limitation of Liability

The Service is provided "AS IS" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Hoka Lash Studio from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Service or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, United States. Any dispute shall be resolved through binding arbitration. (Note: Consult a lawyer to confirm the appropriate jurisdiction.)

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any significant changes.
